On February 10, 2023, Dominic Pezzola, a defendant in the January 6th Capitol Proud Boys trial, filed a motion for mistrial and requested the government's Exhibit 528-1 be struck on the grounds of outrageous government misconduct. Pezzola's legal team claims that the government itself authored the most incriminating document in the case, which was sent to Proud Boy leader Enrique Tarrio just before January 6.
The document, titled "1776 Returns," outlined plans to "storm the Winter Palace" and "fill buildings with patriots," leading prosecutors to suggest that Tarrio and other defendants authored or approved the plan to take over the Capitol. However, new information has come to light that reveals the document was actually created by the government itself.
A member of the US Intelligence community named Samuel Armes revealed in an interview with the House Select Committee on January 6 that the government was responsible for creating the "1776 Returns" document. Armes described how he and his team were tasked with creating a document to be used to set up Proud Boy leader Enrique Tarrio, and that they used the "1776 Returns" document to do so.
Pezzola's legal team argues that the government's conduct is outrageous and warrants a mistrial or the striking of the Exhibit 528-1 and associated evidence. The defense claims that the government's actions amount to a scheme to frame or implicate Tarrio and other defendants, and that the government's evidence is taken out of context.
