YOUR MAIN JOB: LEGISLATION
Malicious Prosecution
Legislate language to clarify and tighten up laws that are being misapplied and over-broadly interpreted to ensure peaceful protesters - help protect against creative prosecution
18 U.S.C. § 231(a)(3) - Civil Disorder
January 6 protesters were charged with felony civil disorder using creative prosecution justified by a grocery store Safeway closure the evening of January 6 that was caused by Bowser’s order, not protesters.
Read Arguments made in: “Case 1:22-cr-00011-RJL Document 135 Filed 07/25/23”
18 U.S.C. § 1512(c)(2) - Obstruction of an Official Proceeding
Post-Enron statute signed into law to close a loophole that allowed destruction of evidence particularly in the form of paper-shredding.
To ensure that no infringement on the constitutional right to petition the Government for redress of grievances occurs in the enforcement of section 1512(c) of title 18 of the U.S. Code, enacted by section 1102 of the Act, which among other things prohibits corruptly influencing any official proceeding, the executive branch shall construe the term "corruptly" in section 1512(c)(2) as requiring proof of a criminal state of mind on the part of the defendant. - GEORGE W. BUSH, The White House, July 30, 2002.
18 U.S.C. § 1752(a)(1) (b)(1)(A) (a)(2) (a)(4) - Entering and Remaining and/or Disorderly and Disruptive Conduct in a Restricted Building or Grounds
Read Arguments made in: “Case 1:23-cr-00005-APM Document 61 Filed 07/26/23”
The USCP's drawing of a line around the grounds on its own electronic map is not public notice of law or of a restricted area.
18 U.S.C. § 2384 - Seditious Conspiracy
Thought Crime - there was no plan to conspire to overthrow. They may claim something like “delay execution of a law… by ‘force’” but the language needs to be more specific so that the charges can’t be weaponized against political rivals. The way it’s written, more mild offenses will be treated at essentially the same level as treason.
Prison Reform
Prevent Solitary Confinement abuses (see Geneva Convention)
Excessive expenses
Commissary
Communications between inmates and people outside are too expensive
Inmates are often not able to have sufficient heat in the winter or cold in the summer
MODERATE: REFER OFFICERS WHO ACTED UNLAWFULLY FOR PROSECUTION
USCP Deputy Chief Waldow and Inspector Loyd need to be asked what dispersal orders the gave and when. CCTV footage, protester footage contradict Waldow’s radio calls and Less Lethal team orders.
MPD Commander Robert Glover needs to be asked why he authorized sting ball munitions at 1:24pm without giving any warnings.
MODERATE: Can Congress do anything about these prosecutors in response to their prosecutorial misconduct including overcharging?
Something like impeachment or firing them? (particularly DC ones)
Investigation needs to be done.
Some of them should be charged maybe for perjury and/or destruction/fabrication of evidence and/or intimidation of witnesses and likely other crimes.
EASY: Impeach AG Garland, Wray, and DC District Court judges (and Biden)
Hold Hearings: demand senior on-ground leadership answer questions under penalty of perjury
Enforce perjury
